Habitat Regulations

Alaska Department of Fish and Game’s Habitat Section is delegated by the Commissioner to implement the state’s Title 16 authority for Fish Habitat and Special Area permitting. Unlike many of Fish and Game’s regulations, which are developed through the Board process and address harvest, Fish Habitat and Special Area laws address land use activities in fish-bearing streams and in the state’s legislatively designated refuges, critical habitat areas, and sanctuaries through a project review and permitting process.

Other statutory responsibilities of the Habitat Section include issuing permits for wildlife hazing in connection with petroleum and chemical spills (5 AAC 92.033), and reviews for fish and wildlife habitat concerns under the Forest Resources and Practices Act (AS 41.17.010-AS41.17.950 and 11 AAC 95.185 – 11 AAC 95.900).
